NOTICE OF SUBSTITUTE TRUSTEE'S SALE NOTICE IS HEREBY GIVEN that by virtue of authority vested in the undersigned Substitute Trustee by that certain Deed of Trust executed by Edward Carroll, to Flynn, Max, Miller & Toney, L.C., Trustee, dated the 18th day of January, 2011, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2368, Pg. 55, which conveyed unto the said Trustee an undivided one-half (1/2) interest in the hereinafter described real estate to secure the payment of that certain indebtedness set out and described therein, and by Substitution of Trustee Agreement dated the 14th day of December, 2016, and recorded in said Clerk's Office in Bonds, Contracts and Leases Book No. 388, Pg. 532, wherein the undersigned Trustee was appointed as successor to Flynn, Max, Miller & Toney, L.C., Trustee, and default having been made pursuant to said Deed of Trust, said Successor Trustee, Paul J. Prunty as Trustee, having been requested so to do by the owner and holder of said indebtedness, shall sell to the highest and best bidder, on Tuesday, the 14th day of February, 2017, at 10:00 a.m.,at the front door of the Courthouse of Cabell County, West Virginia, the one-half (1/2) undivided interest in the real estate commonly known as 1229 Norway Avenue, Huntington, West Virginia and described as follows; All that certain lot, piece or parcel of land, situate in Guyandotte District, Cabell County, West Virginia, known and designated on a map of Revised Plat No. 1, Campbell Place, a copy of which map was filed in the Cabell County Court Clerk's Office on 17 March 1926 in Map Book 3, Map 46, as part of Lots Nos. 4 and 5, and being more particularly described as follows: BEGINNING at a point in the southerly line of Norway Avenue, which point is westerly 20 feet from the corner between Lots 3 and 4, as shown on said map; thence with the said line of Norway Avenue, westerly 57 feet; thence southerly at right angles to the said line of Norway Avenue, 150 feet; thence easterly and parallel to the said line of Norway Avenue, 57 feet; thence northerly at right angles to the said line of Norway Avenue and 20 feet westerly from the line between said Lots 3 and 4, 150 feet to the point of BEGINNlNG; SUBJECT TO an easement 10 feet in wide for sanitary sewer across the southerly part of the described property, the center Hue of which easement is the center line of the sewer as now constructed . TERMS OF SALE: Cash in hand on day of sale, subject to real property taxes assessed and unpaid against said property.
