NOTICE OF TRUSTEE'S SALE NOTICE IS HEREBY GIVEN that by virtue of authority vested in the undersigned Trustee by that certain Deed of Trust executed by Jeffrey Smith and Gina Smith, to Garry L. Boothe and W. Merton Prunty, Trustees, either of whom may act, dated the 4th day of August, 2011, and recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book No. 715, Pg. 18, which conveyed unto the said Trustees the hereinafter described real estate to secure the payment of that certain indebtedness set out and described therein, and default having been made pursuant to said Deed of Trust, said Trustee, W. Merton Prunty, having been requested so to do by the owner and holder of said indebtedness, shall sell to the highest and best bidder, on Friday, the 17th day of February, 2017, at 11:00 a.m., at the front door of the Courthouse of Wayne County, West Virginia, the following described real estate: All that certain tract or parcel of real estate situate in the Village of Ardel, Union District, Wayne County, West Virginia, bounded and described as follows: BEGINNING at a concrete hub situate on the South side of a right-of-way deeded by Edward Stafford. et ux, to J. B. Burgess for the benefit of the public, said right-of way being in the Village of Ardel and extending from the N. & W. Railroad to Twelve Pole Creek, the above-mentioned concrete hub also being a corner to a parcel of land conveyed by John Virgil Cade, et ux, to Clyde Sansom, et ux, by deed dated the 27th day of July, 1968, and recorded in the Office of the Clerk of the County Court of Wayne County, West Virginia, in Deed Book No.379, at Page 116; thence leaving said right-of-way and running with Sansom's line, S. 23 30' W. 224 feet to a wooden post; thence leaving Sansom's property and running 65 W. 244 feet to a stake in the edge of Twelve Pole Creek; thence running down said Creek with the meanders thereof, N. 39 E. 286 feet to a stake in the edge of said Creek; thence leaving said Creek and running S. 45 E. 164 feet to a stake at the original corner of the Gilbert S. Cade, Sr.'s property; thence S. 50 30' E. 32 feet to the concrete hub, corner to the said Clyde Sansom property, the point of BEGINNING, and containing approximately ONE and ONE-THIRD (1-1/3) ACRES, be the same more or less; EXCEPTING, HOWEVER, for the benefit of the property no-w owned by Clyde Sansom, et ux, an easement for a sewer line where the same is now situate across the real estate, together with the right to repair and maintain the same; EXCEPTING, FURTHER. HOWEVER, 0.492 acre conveyed unto James Michael Smith and Nancy E. Smith by Russell Lee Vance, by deed recorded in the Office of the Clerk of the County Commission of Wayne County,West Virginia, in Deed Book No. 512, Pg. 85, and by corrective deed recorded in said Clerk's Office in Deed Book No. 512, Pg. 249; TERMS OF SALE: Cash in hand on day of sale, subject to real property taxes assessed and unpaid against said property.
