NOTICE OF SUBSTITUTE TRUSTEE'S SALE NOTICE IS HEREBY GIVEN that by virtue of authority vested in the undersigned Substitute Trustee by that certain Deed of Trust executed by Edward P. Carroll, to Flynn, Max, Miller & Miller, L.C., Trustee, dated the 30th day of October, 2015, and recorded in the Office of the Clerk of the. County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2594, Pg. 449, which conveyed unto the said Trustee an undivided one-half (1/2) interest in the hereinafter described real estate to secure the payment of that certain indebtedness set out and described therein, and by Substitution of Trustee Agreement dated the 14th day of December, 2016, and recorded in said Clerk's Office in Bonds, Contracts and Leases Book No. 388, Pg. 530, wherein the undersigned Trustee was appointed as successor to Flynn, Max, Miller & Miller, L.C., Trustee, and default having been made pursuant to said Deed of Trust, said Successor Trustee, Paul J. Prunty as Trustee, having been requested so to do by the owner and holder of said indebtedness, shall sell to the highest and best bidder, on Tuesday, the 14th day of February, 2017, at 10:00 a.m., at the front door of the Courthouse of Cabell County, West Virginia, the one-half (1/2) undivided interest in the real estate commonly known as 31 Scenic Drive, Huntington, West Virginia and described as follows: All that certain lot, piece or parcel of ground situate in Guyandotte District, Cabell County, West Virginia, being more particularly bounded and described as follows: BEGINNING at a point in the north line of Clark Estates, Inc. property, said point being S. 87 422' W., 240.42 feet from the white oak corner which is 100 feet, more or less, from the road leading to W.Va. Route #2, and running thence S. 0 58' E., 77.75 feet to an iron pin on the north margin of Scenic Drive; thence with said Drive S. 84 01' W., 118.0 feet to an iron pin; thence N. 7 21' W., 85.67 feet to a point in the north line of said Clark Estates, Inc. property thence with said line N. 87 42' E., 127. 11 feet to the BEGINNING, containing 0.23 acres, more or less; SUBJECT, HOWEVER, to a utility easement as shown on that certain plat recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book No. 732, at Page 563. TERMS OF SALE: Cash in hand on day of sale, subject to real property taxes assessed and unpaid against said property.
