NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 2nd day of February 2005, signed by George W. Chapman, III, a single man, to Doulgas McElwee, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 1989, at page 373, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 9:00 o'clock A.M. on the 9th day of MAY 2017 at the front doors of the Courthouse in Cabell County in Cabell, West Virginia the following described real estate: All that certain tract or parcel of property in Fudges Creek Road near Ona in McComas District of Cabell County, West Virginia being more particularly described as follows: Beginning at a rebar (set) at the southwest right of way line of Fudges Creek Road and at the corner of Harold Nelson (DB 958 PG 515); thence leaving Nelson and running with said right of way South 43-53-17 East 121.07 feet to a point of curve; thence continuing with said line along the arc of a curve to the right having a radius of 170.00 feet and a chord which bears South 27-20-50 East 96.80 feet to a point of langent; South 10-48-22 East 207.06 feet to a point of curve; thence continuing with said right of way line along the arc of a curve to the right having a radius of 374.17 feet and a chord which bears South 02-14-56 East 134.80 feet to a point near the north edge of a gas line clearing; thence leaving the road and running up the hill along the north side of said gas line clearing. Bostic (DB 655 PG 207), South 68-19-59 West passing a ten inch poplar (marked) at 8.4 feet in all 613.52 feet to a ten inch hickory at the top of the fill and North 31-45 East 53.9 feet from a gas well; thence continuing through the land of Bostic, up the center of a point along the East side of an old road, North 18-59-44 West 138.63 feet to an eight inch hickory (marked); North 21-24-24 West 129.05 feet to a six inch black oak (marked); North 34-44-34 West 153.97 feet to a ten inch locust (marked); North 45-35-32 West 163.55 feet to a rebar (set) at the southeast side of an old graveyard in the line of Cledilh H, McCallister (DB 655 PG 204); thence running down the fill with the line of McCallister, North 50-10-36 East 501.50 feet ti a rebar (set) at the corner of Harold Nelson (DB 958 PG 515); thence leaving McCalliser and running around the hillside with the line of Nelson, South 44-53-32 East 264.00 feet to a rebar (set)' North 47-38-33 East 166.00 feet to the point of beginning with twenty four foot wide right of way from Fudges Creek Road to the south side of this parcel as shown on the accompanying plat. (actual location of said right of way to be determined by construction). Plat being attached to that deed recoded in Deed Book 1041, at page 666. Map/Parcel #: 12 22.4, Ticket No. 41402 It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: RT 2 Box 468 Milton West Virginia 25541 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded.
