NOTICE OF SUCCESSOR TRUSTEE'S SALE (WITH PUBLIC SALE OF MANUFACTURED HOME) NOTICE IS HEREBY GIVEN by virtue of the authority vested in the undersigned Successor Trustee, Jonathan Nicol, by that certain Substitution of Trustee Agreement, dated January 6, 2017, executed by Bank of Mingo, recorded in the office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book 782 at page 529, being the same authority which was originally vested in Scott Maddox or Harry K. White, as Trustee, either of whom may act, in that certain deed of trust made by WILLARD MARCUM and DELORES MARCUM dated May 13, 2005, recorded in said Clerk's office in Trust Deed Book 613 at page 854, the makers of the instrument secured by said deed of trust are in default, and Bank of Mingo, the current beneficial owner and holder of said instrument, has elected to treat the whole principal debt thereby secured as immediately due and payable. NOW, THEREFORE, the undersigned Successor Trustee, having been requested by the beneficial owner of said instrument to do so, will proceed to sell at public auction at the front door of the Courthouse of Wayne County, in the City of Wayne, West Virginia, at 11:15 o'clock a.m. on Friday, June 9, 2017, for cash to the highest bidder, all of the following described real property, together with the improvements thereon and appurtenances thereunto belonging, located in Lincoln District, Wayne County, West Virginia, and being more particularly bounded and described in said deed of trust as follows: A parcel of real estate situate in Lincoln District, Wayne County, West Virginia, and being more particularly described as follows: Beginning at a 3 inch iron stake located 25' N of the centerline of Route 3/5 N 215 going N to a 4 inch beam located directly beside an APCO telephone pole with ID#629-03-86; thence going E 276' to a 3 inch iron stake located by a 12" Oak Tree; thence from said point going S 200' to a 3 inch iron stake located 25' N of the center line of Route 3/5; thence going W 276' to the point of beginning. Being the same property conveyed to Willard and Deloras Marcum, from Sabrina Deskins, by Deed dated March 13, 2003 and of record in the Office of the Clerk of the County Commission of Wayne County, West Virginia in Deed Book 625 at Page 166. The property is located in Wayne County at Twelve Pole Creek, Wilsondale, West Virginia 25699. In addition to the real property described above, this sale will also include and the purchaser will acquire that certain manufactured home located on the said real estate and being described as a 2003 Fleetwood doublewide, Serial No. TNFL 327A58722CY13 and TNFL327B58722 CY13. This sale is to enforce the rights of Bank of Mingo, as secured party in the described collateral, which is the subject of a Promissory Note, Truth-In-Lending Disclosures and security agreement, dated May 13, 2005, and entered into between Bank of Mingo, as lender and secured party, and Willard Marcum and Delores Marcum, as borrowers, and which is currently in default. The collateral manufactured home is being sold on an as-is basis. Anyone desiring to inspect the said real property or manufactured home can contact the undersigned Successor Trustee at (304) 345-8900, who will undertake to make arrangements for the inspection. The undersigned Successor Trustee reserves the right to adjourn this sale from time to time as the interests of the parties may require, and without any notice other than by oral proclamation at the time and place appointed for sale and further reserves the right to cancel the sale in his sole and absolute discretion. This sale shall be made subject to any prior lien, liens entitled to priority over the lien created by the subject deed of trust, restrictions, conditions, reservations and easements contained in deeds or instruments of record in said Clerk's office, and subject further to all unpaid real estate taxes and special assessments, if any, the purchaser assuming the payment thereof. The undersigned Successor Trustee will deliver to the purchaser a deed conveying the subject property without any covenant or warranty, express or implied. The purchaser shall be responsible for the payment of any transfer taxes and recording fees necessary to place of record the aforesaid deed. The undersigned Successor Trustee further reserves the right to accept or reject any and all bids in his sole and absolute discretion. In the event the subject property is occupied, the undersigned Successor Trustee shall be under no duty to cause any existing tenant or occupant to vacate the subject property.
