NOTICE OF TRUSTEE'S SALE Under authority of that certain Deed of Trust dated August 28, 2002, from Etta Mae Porter and Alene Robinson to Dru A. Shope, Trustee, of record in the office of the Clerk of the County Commission of Wayne County, West Virginia in Trust Deed Book No. 551, at page 265, securing a promissory note in the principal amount of $54,535.00, payable to CMH Homes, dba Luv Homes, and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., as Assignee of the aforesaid Deed of Trust, the undersigned Substitute Trustee will offer for sale at the front door of the Wayne County Courthouse in Wayne, West Virginia on August 16, 2017 at 10:00 a.m., subject to all reservations, exceptions, easements, outsales and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate on the Left Fork of Mill Creek, Lincoln District, Wayne County, West Virginia, bounded and described according to an actual survey of the same made by J. W. Alley, Surveyor, on the 5th day of September, 1967, as follows: Beginning at a set stone on the bank of Rush Branch of Mill Creek, and running up the hill with the Albert Jackson line between a double sycamore and an elm stump at a distance of 125 feet, N. 50 30' W up to a point 1,136 feet to a large sassafras stump on top of the hill at Bird Thompson's line; thence with his line, N. 42 30' E. 295 feet to a persimmon and hickory on the ridge, N. 6 30' E. 189 feet to a sassafras and dogwood on the ridge at the Jim Wilson line, and with his line down the hill, N. 76 20' E. 585 feet to a stake in the branch, (formerly an old elm stump, now a marked stone on the east side of the branch); thence down the branch S. 18 40' E. 186 feet to a sycamore in the branch S. 27 30' E. 156 feet, S. 34 30' E. 37 feet to a marked stone protruding out of the north bank and about 20 feet west of a hanging cliff over the edge of the branch; thence leaving the branch and running up the hill with the Charlie Hampton line, N. 71 30' E. 520 feet to a beech on a bluff at the Joe Lambert line; thence running right with said Lambert line, S. 3 W. 520 feet to a large, ugly black oak on the point back of a cemetery; thence down the hill with the same line, S. 22 E. 444 feet to a marked stone in the branch at the Mill Creek Genoa Road; thence crossing said Road and running with the branch, S. 37 45' W. 158 feet to a sharp bend in the branch, N. 21 30' W. 88 feet to a stake in the branch by the said Road, thence with the meanders of the branch, S. 88 25' W. 450 feet, S. 67 W. 134 feet to the beginning containing TWENTY-SEVEN and FOUR TENTHS (27.4) ACRES, more or less. There is excepted from the above-described property any outsales of any portion of said property. Being the same property conveyed from Roary Varney and Lucy Varney, his wife, to Robert Porter and Etta Mae Porter, husband and wife, by Deed dated November 2, 1970, of record in the aforesaid Clerk's office in Deed Book No. 399, at page 170.
