NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 17'hday of January, 2011, Hayton Properties, LLC, Grantor, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed ofTrust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2386, beginning at page 385, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 391at page 53 having been requested to do so by the Lenderand default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on September 25, 2017 at II :00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: PARCEL ONE: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, and being a part of the land conveyed to R.A. Ferguson, by the Huntington Land Co. and being described as follows: BEGINNING at a stake in the south line of Roby Road, said stake bears N 79 47' E 17.5 feet from the northeast comer of Lot 61 of the Holswade lots, thence with said road N 79 47' E 50 feet to a stake, thence leaving the road S 14 46' E 183 feet to an iron pin, N 34 22' W 91.5 feet to a stake, S 79 47' W 24.5 feet to a stake, thence N 11 43' W 99 feet to the BEGINNING. EXCEPTING HOWEVER, that portion of the above described property conveyed to Jackie Conner Ray, II and Lola Denise Ray by deed dated May 23, 2001 and recorded in Deed Book 1079 at page 428. PARCEL TWO: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, and being a part of the land conveyed to R.A. Ferguson, by the Huntington Land Co and being described as follows: BEGINNING at a point in the south line of Roby Road, said point being in the east line of the Jennie King tract, said beginning point being now the northeast corner of Lot No. 61, as shown on a map of Holswade Land Co., Roby Road Lots, which map is of record in the Cabell County Court Clerk's Office in Map Book 2, as Map 250; thence with the said line of Roby Road, N 75 E 55 feet; thence leaving said road line, S 36 30' E 200 feet; thence S 75 W, 55 feet to a point in the said east line of the Jennie King Tract; thence with the said King line, and the east line of said Lot No. 61, N 36 30' W 200 feet to the point of BEGINNING. RESERVING HOWEVER, a 15 foot right of way for sewer as conveyed to the City of Huntington. FURTHER EXCEPTING AND RESERVING that portion conveyed by deed dated March 7, 1951 and recorded in Deed Book 441 at page 273. PARCEL THREE: All that certain lot, piece or parcel of land situate in the City of Huntington, Gideon District, Cabell County, West Virginia, on the south side of Roby Road and bounded and described as follows: BEGINNING at a point in the south line ofRoby Road at the easterly corner of the lot conveyed by Rilay A. Ferguson to L.F. Nicholas by deed dated September 23, 1915, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book No. 144, page 207; thence with the line of said Nicholas lot, S. 34 22' E. 161.25 feet to a point; thence N. 76 39' E. 38 feet, more or less, to a point; thence N. 22 32' W. 150 feet to a point in the south line of Roby Road; thence with the same, S. 76 39' W. 70 feet, more or less, to the point of BEGINNING. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter II of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
