NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 27, 2008, executed by Borrower(s), Patricia F Hynson and Joseph F McCloud, to Metz Law Office, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2232, at Page 114. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 911 28th St, Huntington, WV 25705. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 19, 2017, of record in the Clerk's Office in Book 392, Page 1. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 17th day of January, 2018 at 11:00 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Gideon District, Cabell County, West Virginia, and being more particularly described as follows: The following described real estate: A certain tract of land situate in the City of Huntington, Cabell County, West Virginia, being a part of Lot Number 40, as shown on the Revised Map of the City of Huntington, made by L. W. Leete, Engineer, and being more particularly bounded and described as follows: Beginning at an iron pipe (found) marking a corner common to the lands now or formerly owned by A. D. Tony, et ux, (Deed Book 527, at Page 274), and the lands of the Jennings A. Ellis Estate (Deed Book 313, at Page 462), from which an iron pipe (found) bears South 15 degrees 49 minutes East, 57.18 feet, and a second iron pipe (found) bears South 75 degrees 05 minutes West, 150.00 feet; thence, leaving the lands of the said Tony et ux, and severing the lands of the Estate, North 32 degrees 54 minutes West, 59.63 feet to a point in the north line of the lands of the said Estate; thence, with the said north line, North 76 degrees 02 minutes East, 141.99 feet to an iron pipe (set) on the west side of 28th Street; thence, leaving the said north line, and with the west side of said street, South 29 degrees 27 minutes East, 56.15 feet to an iron pipe (set) on the south line of the said Estate; thence, leaving the said street and with the said south line, South 75 degrees 05 minutes West, 137.65 feet to the beginning, containing 7,745 square feet, more or less, as surveyed by Ronald L. Eastham & Associates, Inc., on May 17, 1976. AND being the same real estate conveyed unto Ralph and Jewell Wyant by that deed from Charlotte Avonelie Hamlin, dated January 13, 1997, and of record in the Office of the Clerk of the County Commission oh Cabell County, West Virginia in Deed Book 1012, at page 451. The said Jewell Wyant died on or about February 18, 2008, thereby leaving Ralph Wyant as the sole surviving joint tenant. Map/Parcel Number: 33/46.1 Commonly known as: 911 28th Street, Huntington, WV 25705 Being the same property conveyed to Patricia F Hynson and Joseph F McCloud by the Deed dated June 27, 2008 and recorded in Deed Book 1189 at Page 351 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
